Terms of Service

1. Description of service

mcpchannel.ai is a directory and marketplace for MCPs, APIs, skills, and related offerings. We provide discovery, listing, and optional paid placement. We do not operate, host, or control the underlying APIs, MCP servers, or third-party services listed on the Site. Those are provided by third parties; we are not responsible for their availability, accuracy, safety, or conduct.

2. Listings, APIs, and safety — accept before you use

Listings, skills, and APIs on the Site are created by third parties. We may, at our discretion, attempt to evaluate or review listings or APIs for safety, security, or quality. There is a limit to what we can do. We do not guarantee that any listing or API is safe, secure, accurate, or fit for any purpose. Evaluation (if any) is not an endorsement and does not create any duty or warranty. You use any listed service entirely at your own risk. You must accept that we cannot guarantee safety or performance of any third-party service before you use the Site or any listing. We are not liable for any harm, loss, or damage arising from your use of any listed API, MCP, skill, or other offering.

Some listings, MCP packages, or agents displayed on the Site are sourced from public registries or GitHub repositories. We do not own, maintain, or endorse these third-party repositories. Repository contents can change at any time without notice to us or to you. We are not responsible for the accuracy, safety, legality, or fitness of any code, tool, or service found in or linked from a third-party repository. Always review source code and repository history before installing or running any MCP server, agent, or tool. Installing or running software from any source is your sole responsibility.

3. Termination of service

Any service or subscription you have through or in connection with the Site may be terminated by us at any time, with or without cause or notice. We may suspend or terminate your account, access, or any paid placement or subscription. Termination may be due to abuse, non-payment, violation of these Terms, or for any other reason. If a listed third-party provider discontinues or changes its service, that is not our fault; we are not responsible for the actions of third parties. We are not liable to you or any third party for any termination. Upon termination, your right to use the Site and related services ceases immediately.

4. Advertising and placement fees

Placement fees apply for featured listings, MCP client placement, skill placement, and other advertising. Current pricing is shown on the Advertise with Us page. Placement fees may change at any time. The fee that applies is the one stated when we confirm your placement or in our follow-up. By submitting an advertising request, you agree to the terms and pricing in effect at that time. Fees are generally non-refundable unless we agree otherwise in writing.

5. Platform fee on subscriptions

For paid (Pro) subscriptions to listings, we currently retain 5% of subscription revenue as a platform fee; the remainder is paid out to the listing provider. This percentage may change in the future. We will post the current rate on the Site (for example on the homepage or in a dedicated pricing or terms section). Changes to the platform fee will apply to future subscription periods; we may notify providers and/or consumers when the rate changes. By offering or subscribing to paid listings, you agree to the platform fee in effect at the time of the transaction.

6. Disclaimer of warranties

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE OR ANY LISTING WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SITE AND ANY LISTED SERVICE IS AT YOUR SOLE RISK.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY LISTED SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Site or any listed service, (b) your violation of these Terms or any law, or (c) your violation of any third party’s rights. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you.

9. MCP Clients Directory

The Site includes a directory of MCP-compatible clients and tools ("MCP Clients"). Entries in this directory are provided for informational purposes only. We do not own, operate, maintain, or endorse any third-party client or tool listed. Listing a client does not constitute a partnership, affiliation, or endorsement.

Some MCP Client listings may be sponsored placements purchased through our advertising program. Sponsored entries are displayed with a "Sponsored" badge. Sponsored placement is a paid advertising service and does not constitute our recommendation, review, or certification of the client. The presence or absence of a sponsored badge has no bearing on the quality, safety, or suitability of any listed tool.

We are not responsible for the availability, functionality, pricing, security, or conduct of any MCP client listed on the Site. Your use of any third-party client is entirely at your own risk. Sections 6, 7, and 8 of these Terms apply in full to MCP Client directory listings.

10. Community Skills

The Site allows community members to submit SKILL.md prompt packages and scripts ("Community Skills") by providing a link to a public GitHub repository. Community Skills are user-submitted and not created, owned, reviewed, verified, or endorsed by us in any way.

No platform key or subscription is required to use Community Skills. They are personal or community-driven works shared freely by their authors. The platform is a directory only — we do not host, execute, proxy, or distribute the skill files themselves.

By submitting a Community Skill you represent and warrant that: (a) you are the author or have the right to share the skill; (b) the skill does not infringe any third party's intellectual property rights; (c) the skill does not contain malicious code, malware, or content that violates any law; and (d) the skill's GitHub repository is public and accessible. You are solely responsible for your submission and any consequences arising from its use.

We are not liable for any harm, loss, data breach, security incident, or damage arising from your use of any Community Skill, including but not limited to skills that contain malicious code, produce harmful outputs, or behave unexpectedly. Always review the GitHub repository and its contents carefully before using any Community Skill. You use Community Skills entirely at your own risk.

We reserve the right to remove, hide, or delist any Community Skill at any time and for any reason, without notice or liability. We may but are not obligated to review or moderate Community Skill submissions. Removal of a listing does not create any duty to monitor or any liability for content we did not remove. Sections 6, 7, and 8 of these Terms apply in full to Community Skills.

11. General

These Terms constitute the entire agreement between you and us regarding the Site. We may modify these Terms at any time; the updated version will be posted here with a new “Last updated” date. Your continued use after changes constitutes acceptance. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
